Acceptance of Terms

Welcome to FitJot, a mobile fitness tracking application provided by Ecoweb Softech Services Private Limited ("we," "us," or "our"). By downloading, accessing, or using the FitJot app (the "Service"), you agree to be bound by these Terms and Conditions.

Health & Medical Disclaimer

• Always consult your physician or other qualified health provider before starting any new fitness program, diet, or training routine.
• The workouts, exercises, and fitness routines in the app are for informational purposes only.
• You use the Service at your own risk. We are not responsible for any injuries, health problems, or damages that may result from following the exercises or programs available in the app.
• If you experience faintness, dizziness, pain, or shortness of breath at any time while exercising, stop immediately.

User Accounts

To access certain features of the Service, you must register for an account (e.g., via Sign in with Apple, Google Sign-In, or Phone/SMS authentication).

• Accuracy — You agree to provide accurate, current, and complete information during registration.
• Security — You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account.
• Termination — We reserve the right to suspend or terminate your account at any time if we suspect you have violated these Terms or engaged in fraudulent or abusive activities.

Your Content

The Service allows you to create, log, and save your own fitness data, including custom workout programs and logged sessions ("User Content").

• Ownership — You retain all rights to the User Content you create within the app.
• Responsibility — You are solely responsible for the User Content you log. It is private to your account and is not shown to other users.
• License to Us — By storing User Content on our servers to enable cloud syncing, you grant us a worldwide, non-exclusive license to host, store, and process this content solely for the purpose of providing the Service to you.

Acceptable Use

You agree not to use the Service in any way that:

• Violates any applicable local, national, or international law or regulation.
• Infringes upon the rights of others (including intellectual property or privacy rights).
• Involves transmitting harmful code, viruses, or attempting to compromise the security of the app or our servers (e.g., Firebase, MongoDB).
• Attempts to reverse engineer, decompile, or disassemble any part of the Service.

Intellectual Property

All content provided by us within the app (excluding your personal User Content and third-party material), including but not limited to the app's design, text, graphics, algorithms, and logos, is the property of Ecoweb Softech Services Private Limited and is protected by intellectual property laws.

Open-source software and artwork used in the app are licensed under their own terms, which are listed in the app under Settings → Open-source licenses.

Third-Party Services

FitJot uses third-party services, including Google Firebase (authentication, analytics, crash reporting, performance monitoring and remote configuration), Sign in with Apple, Google Sign-In, and a server we operate at Hostinger that stores your data in MongoDB. Your use of the Service is also subject to the terms and privacy policies of these providers.

We are not responsible for the availability or actions of these third parties.

Limitation of Liability

To the maximum extent permitted by law, Ecoweb Softech Services Private Limited and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service.
• Any unauthorized access, use, or alteration of your transmissions or content.

Changes to These Terms

We may update these Terms from time to time. We will notify you of any changes by updating the "Last Updated" date at the top of this document. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the updated terms.

Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-law rules. Ecoweb Softech Services Private Limited is registered in India.

You agree that any dispute, claim or controversy arising out of or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts in India, and you consent to the personal jurisdiction of those courts.

Nothing in these Terms limits any mandatory consumer-protection rights you have under the laws of the country where you live.
